You should have protested in the Spring. Tax increases are supposed to be limited to no more than 3% per year unless the house changes hands or some major improvement is made. I think you will have to go to court now.
N,valley Property taxes (albuq,nm)
I called the assessors office and was not given a clear answer as to why my taxes went up 1600.00 a year on a home I paid 142k for. They have the value at 244,100.00 and I paid for an appraisel that appraises it at 160,000.00 back in may of 2009. they also said I should have protested it last april, but I did'nt own the house until may, now they said I would have to go to district court and file an appeal there or wait until next april. We are getting ripped off and our Governor, Mayor, And everybody else at city hall is not doing anything about it. HOW do you explain 300.00 a month on property tax, that's almost half of the amount I financed, 3,597.000 a year for a 142,000 house. How do they expect people to live and this economy to get better when we are getting F.........! IS THERE ANYTHING WE CAN DO, OR JUST KEEP TAKIN IT IN THE SHORTS YEAR AFTER YEAR....

By the way it is too late to file a protest although you can still file an action with the court. Look on the back side of your tax bill for the guidelines.

My property tax has more than tripled since I bought my North Valley house in 2006. Meanwhile, my property value has certainly decreased. Mon, Nov 16, 2009, 9:30 a.m. MST -- Phil is charged with four counts -- disorderly conduct, concealing his identity, refusing to obey an officer, and criminal trespass. He is being arraigned this morning.
It is unclear whether police were called because of Phil's refusal to show ID to TSA, or because Phil took photos at the TSA checkpoint. It appears to be the latter -- the photo taking. Interestingly, Phil contacted the Albuquerque airport (scroll down a bit and look for the pmocek posts) many months ago about this very same issue, and was told by airport officials that it is legal to take photographs at the TSA checkpoint.
After much scrambling, we found an attorney who (hopefully) is representing Phil at his arraignment. His bond was initially set at $2,275. The bonding window doesn't take phone payments, so we need someone local to bail him out (either the lawyer, or a bail bondsman). We've set up a paypal account for Phil's Legal Defense Fund.
Mon, Nov 16, 2009, 12:20 p.m. MST -- The lawyer we got hold of didn't get to his arraignment in time. It appears Phil was arraigned and put back in the Metropolitan Detention Center, with no modifications to his bond. We've contacted a bonding company and are working to get them 10% bond payment information and license copies via frustrating fax technology. The bond will cost $275, and of that, $228 is non-refundable.
We've continued talking with a few civil rights attorneys in Albuquerque, in hopes of finding someone willing to 1) deal with the litany of criminal charges they threw at Phil for his amateur photography, and 2) seek redress after that. Currently, Phil is still incarcerated.
Mon, Nov 16, 2009, 4:20 p.m. MST -- We think we've finally posted Phil's bond. According to most sources, he should be out of the Albuquerque Metropolitan Detention Center in 4-8 hours. We are working to secure him legal representation in Albuquerque. Cost estimates are about $2,000-4,000 for a retainer. Hoping he has heard somehow that people have been working to get him out. Incommunicado for 28 hours and counting.
Mon, Nov 16, 2009, 6:45 p.m. MST -- Phil is now listed as bonded meaning he's free to go. The jail said they will let him out in an unknown amount of time -- approximately 4-6 hours or so.
Activist arrested at Albuquerque airport (Albuquerque)
ALBUQERQUE, N.M. NOVEMBER 15, 2009 — A Washington State medical marijuana activist was arrested at the Albuquerque airport today after refusing to show ID to TSA screeners. Activist Phil Mocek is one of many Americans who believe Americans have a right to travel freely between the states without showing their papers to the federal government.
Mocek was tabling at the 2009 International Drug Policy Reform Conference for a Seattle-based activist group called the Cannabis Defense Coalition. The event was attended by over one thousand people, including New Mexico Governor Bill Richardson, and former Governor Gary Johnson.
At the Albuquerque airport for his flight back to Seattle, Mocek politely refused to show his ID to a TSA screener, who called in a supervisor. Mocek started recording with his digital camera, which caused the TSA supervisor to become extremely agitated. The police were called in, with six officers arriving on the scene. Mocek was immediately arrested. Another Seattle activist, Jesse Gallagos, was traveling with Mocek, and was driven in a police cruiser to the edge of the Albuquerque airport, dropped off, and told he was banned from flying for 24 hours.
Like many Americans, Mocek has flown for years without showing ID to federal officials. He made headlines last year for questioning security measures at Kansas City Airport in regards to their ID requirements. See:
At this point, it remains unclear what Mocek was arrested for. Unofficial police statements say is being booked for "disturbing the peace" by taking photographs at a TSA checkpoint. As of 5 p.m. Sunday, Mocek has been in police custody for four hours, and is still being "processed" by airport police.

Thank you for sentence one in your post. I have no problem calling a legalized (govt) union of two persons a domestic partnership. Which could be used for many people, not just the GLBT community. Holy Matrimony is defined as a union of a man and a woman in certain churches, and I believe should stay that way. If GLBT or open and affirming churches choose to provide marriage services for any members than so be it. But legally we should all have access domestic partnerships. Domestic Parnterships would solve many people faced by hetrosexual couples......i.e Second time partners and estate planning. No more pre-nups! All I, and speaking for millions in my community want are equal laws to protect assets, taxation issues, wills, healthcare directives, employement discrimination, etc.....

I have been following this thread without comment until now. I'm puzzled because the whole "boycott Lotaburger" hinges on the owner providing dollars to shoot down Prop 8 in California. Uh, what does Prop 8 have to do with NM. If your concerned about CA then move there. I don't recall any action being taken against gays here in NM by Lotaburger.
Although I support the right of gays to have civil unions I absolutely oppose "marriage" rights being extended. Marriage is between man and women. I also oppose "gays" being extended special status "as minorities". I'm sick of everyone wanting to be "special". Even fat people want to be treated as "special" and be protected. Give me a break. The standard federal tax exemptions for your family must be great. Now why would it bother you for me and my lifetime partner like you and yours, have the right to atleast get a deduction for 2 wage earners? Do you think that we can change one of your children into being gay or lesbian? Would you love them any less if they were? Well unless you are the Osmond family, chances are one or of your offspring is homosexual. Why would it bother you for me to decide my who my pension plan goes to? Why would it bother you for me to decide who my estate goes to? Without the worries of homophobe family members that cast me away for being me? I am just wondering why these things that hetrosexual couples "automatically" get bothers you? This is not an argument of my choice or my creation. This is a quest to really find out why some hetrosexuals deny the same things to others that they get? In a country that is build on equality, I ponder why this is so bothersome. For the record, I do not support legalized same sex marriage ( yes I am gay) nor do I support legalized opposite sex marriage. Marriage is a religous institution and should reamain as such. Our government needs to recognize only rhe legal aspects of the individual. Thank you so much poster for informing me that Blakes Lotaburger supported such a foolish cause. Im not gay myself, but I find the denial of gay peoples right to be married in their own religious traditions etc. if they so choose to be an infringement upon the religious freedom of american citizens in general. I also feel that people that make long term commitments to each other should be afforded the right to set up civil unions and recieve benefits from their spouse or partner. "Marriage" is a religious institution. IF your church does NOT want to recognize a marriage in your tradition...that is your business...However, if the government does not allow a church tha DOES choose to recognize a marriage within their tradition, how can that be defended as anything but unconstitutional? The only constitutional remedy if you dislike the idea of gay marriage is to have the government choose not to recognize ANY marriages. Sorry, there is no other constitutional and intellectually consistant option. If you want to have the right to marry, every one else gets to have it too. IHOP (Montano/I-25)
I just have to pass this on....this just really blew my mind!!!! My sister and I met at the IHOP located next to Petsmart on Montano & I-25 for an early dinner with our daughters. There is a huge poster displayed on the window that reads: KIDS EAT FREE MONDAY THROUGH THURSDAY FROM 4PM till 10PM. Great, we said, and unexpected bonus!!! On EVERY table there are the placecards displaying the same message. The service was great, the food was good, but when the bill arrived, we had been charged for the kids meals!!! I asked our waitress about it, and she said that "management requires the customer to ask for it".....WTF???? Um...it is around 6pm, it is a Wednesday night, and our girls are obviously uner 12 years old! Not to mention that the place is strewn with advertisements regarding that!!!! So, the waitress had to go back and fix the ticket....just wanted to share my expierience!!!

Yes, 3% per year unless a change takes place. HOWEVER, if improvements have been made and not reported then the situation differs. In this case, I think there is no doubt of that. The description of the house leaves me to believe that extensive improvements were made yet never factored in either by non-reporting or neglect or whatever. Tax lightning needs to end and everyone pay the current market price for their properties.

I didnt read the article. But in Albuquerque that would be how it works. Your house only gets reassesed when it gets sold. So if you bought your home 30 years ago for $20,000 your property taxes are based on your home being worth that much until its gets sold, then the taxes are based on what it was sold for.

There is an interesting article on the blog, EYE ON ALBUQUERQUE about "unclassified" or "exempt" employees. These are employees who are directly hired by the governor or Mayor Marty. These political appointees are costing us millions. Sure, some are needed but look at the numbers in the article.

Property Tax Bill: Only $334 on $925K Home (Cerrillos)
NM tax lightning tax bills have made many upset. This should add fuel to the fire. In this morning's Albuquerque Journal, on the front page, is an article about a Cerrillos home on the market for $925,000 showing current taxes as $334, YES, $334. Properly assessed, the bill would be about $5600. According to the article, the home is valued at only $64,000 for tax purposes. What is most disturbing is the comments by the County Assessor who says he has properties that aren't even on the tax rolls or haven't been reappraised in years.
Tax lightning needs to end and ALL homes need to be brought to current market prices for tax purposes. I wonder how many homes have been "purposely" left off the rolls or not reappraised. Is NM a banana republic or what?

I made an earlier post - critizing the HC system in general as a sham, which for the most part it is. There are trully legitimate handicapped people but they are few, very few from my years of observation of the HC system. Most pull up in front, jump out and walk all through big box stores, the fair grounds, the ballon park, etc without any problem. It makes no sense and is really about preferential parking, not being handicapped.
My mother requires use of a walker and cannot even walk from HC parking slots to the front door. I have to help her out at the entrance and then use a wheel chair. What does she need a HC placard for, she can't drive but of course she would qualify and still has a license (but no car - we sold it to keep her from being tempted to do so).
One poster made a comment about disabled vets - which I happened to be. And I could get a placard - I'm able to walk miles yet I would have no problem if I wanted to obtain one because I have the medical history from 22 years of Army service to support it. For those that don't know, most vets who are disabled are still capable of walking and do not need "special" parking. Most vets you see driving around with the DV plates (which means they are 100% disabled) are that way because of diabetes or heart problems not because of military related wounds or actions. For example if you have a family history of some illness like diabetes and it becomes apparent while your serving in the military then you will qualify for disability. There are also many vets who are disabled for mental reasons, which has nothing to do with their ability to walk. Of course there are exceptions but I'm talking in general. I have also seen vet DV plate vehicles parked in HC parking which is a violation unless they have a HC placard. DV plates do not qualify for HC parking by themselves. I recently saw a DV plate vehicle parked in a HC slot in front of Sears where the driver was loading a large box in the back, a box he carried out of the store with the help of his wife. He had no placard but thinks he's entitled to HC parking. Now some might think all DV plate vehicles should be allowed to park in HC slots but then that would be granting "preferential" treatment not parking based on true need. As the population ages more and more HC slots will be needed unless some real standards are put in place. HC parking is a joke as far as I'm concerned; I have seen too many abuses and have known several who have them yet are not trully in need. To them its about not having to look for a parking slot.
Businesses are required to have HC slots available but I'm sure there are exceptions and the Wendy's may be in that category especially since its downtown. And the original poster said 50 YARDS not 50 feet, big difference although if your an APS grad you may not know that. No one is knocking the lady in the wheel chair, as she is obviously in need. And to the Taliban censor - in America we have the right to express an opinion. I expressed mine so don't get your pink panties in a bunch over it and condem me as a Nazi. Sounds like something a Republican Bush supporter would say. If you think the people using HC parking are all entitled to it then I suggest you do some objective observation. When I saw the guy on a Harley with a HC license plate it woke me up and I started paying attention much to my dismay.

My mother is in her eighties and lives with us. She is quite frail and in a wheelchair. Even in her wheelchair, every little bump and/or crack in the cement we go over makes her wince in pain. She loves to go out, however, and I don't see any reason to deny her this pleasure. Shops and restaurants that do not have handicap parking are stupid in the first place for limiting their customer base and quite possibly breaking the law. I have no opinion on "the boot" debate, but when you start disparaging those who cannot go 50 feet, you are showing true ignorance.

Walk 50 yards!!! Wow, I bet when you go to WalMart to shop you park out front and walk 300 yards while inside the store. A big thumbs up for Wendy's. Its doing its part in the fight against fat by making its customers bust a few fat cells (that they would gain from their burgers).
Handicapped parking is a scam anyway; the vast majority who have the placards/plates shouldn't. While living in AZ I even saw a Harley with a handicapped license plate. Placards should be limited only to those who need assistance to walk. How many people do you see pull into a HC slot then walk into a big box store where they walk up and down the aisles without a problem. My favorite place for HC watching is the state fair. Next time it comes around spend a few minutes watching the scam in progress.

I knew about tax lightning when I bought my home so just chalked it up to another unfairness in life, of which there are many. Is anybody upset about the HUGE increase in property taxes? (Rio Rancho)
Just wondering if I am the only one concerned about the HUGE increase in property taxes for people that have recently purchased a home. People that have owned their home over 2 years will only face a MAXIMUM 3% increase, but people who have recently bought homes will have about a 50% increase. There is a lawsuit challenging this in Bernalillo County, but I have not heard about any challenges in Sandovel Couinty. I have left numerous messages for people working for the County requesting information on how to legally challenge it, but nobody will even return my phone calls. There have been rulings by 2 judges who stated that this type of tax increase is unfair and unconstitutional, but nobody seems concerned about it. We just recently moved here from Wisconsin and if the officials in Wisconsin tried something like this, people would be standing outside the courthouse with pitchforks! Guess all the sunshine here just makes everybody really mellow and laid back! Would appreciate hearing from other people! Thanks-Carol

The key is these are taxpayer supported individuals making decisions with taxpayer money. As a former US Govt employee I was prohibited from taking any gifts unless it was of marginal value (under $20) that was made generally available, like a conference where there are lots of different folks represented. I would think the city would have something similiar but then this is New Mexico ...
Comparing a doctor and pharmaceutical companies does not apply here since doctors are typically not public servants nor are they the user of the product. I do agree with you though that there are not a lot of facts but unfortunately we are getting our info from a blog and not a typical news source. I am a daily reader of the ABQ Journal and have yet to see an article about this or the one about the blown FBI investigation. I am also a routine reader of EYE ON ALBUQUERQUE and have always found them to be credible.

Your equation to doctor's taking pharmaceuticals is nice in theory, but let us evaluate the comparison.
The drug samples that are provided to doctors generally value under $1000. However, regardless of exact value, the samples are NOT provided for the doctor’s use, private or public. They are provided for the doctors to distribute to patients who may need the drug prescribed. Also, the drugs provided are NOT limited to a selected few doctors or patients. Instead, they are provided to multiple doctors and given to any patient who has a medical necessity for the drug.
The guns given to the select few individuals are valued at over $1,000 a piece. It would stand to reason that any and all government and public officials, whether elected or appointed, have, or should have, guidelines that limit or cap the value of personal gifts given to them. (Generally that tends to be UNDER $100.) Second to that, these weapons were given as gifts to a select few individuals. If it was S&W’s intent to simply have the APD review the service worthiness of their firearms, then why not provide a sample of such to, say, the police academy? There, multiple individuals would have the opportunity to experience the firearms in action. This then would been seen as a general gift to the department as a whole, or if you will, a SAMPLE of their 9mm to be evaluated by the department as a whole.
As it stands, giving these expensive guns to a select few individuals appears more as a bribe than a charitable gift. And the ONLY person benefiting from the gift is the individual that received it, NOT the department.
I hope you are able to grasp the delineation between where a gift stops and a bride begins.

The blog, EYE ON ALBUQUERQUE, reported yesterday that APD is changing its service weapon from Glock 9mm to S&W 9mm. Seems some "freebie" 9mm were provided by Smith & Wesson to the police chief, his deputy and Mayor Marty a month before the decision to switch was made. Again the EYE is reporting what the ABQ Journal can't seem or won't do. The EYE reported earlier this month about a FBI undercover operation that was blown by the APD. Let's hope the new mayor cans the chief.
