In one leaked e-mail, the research center's director, Phil Jones, writes to colleagues about graphs showing climate statistics over the last millennium. He alludes to a technique used by a fellow scientist to "hide the decline" in recent global temperatures. Some evidence appears to show a halt in a rise of global temperatures from about 1960.
Jones wrote that, in compiling new data, he had "just completed Mike's Nature trick of adding in the real temps to each series for the last 20 years (i.e., from 1981 onwards) and from 1961 for Keith's to hide the decline," according to a leaked e-mail, which the author confirmed was genuine.

One of the colleague referred to by Jones — Michael Mann, a professor of meteorology at Pennsylvania State University — did not immediately respond to requests for comment via telephone and e-mail.

The use of the word "trick" by Jones has been seized on by skeptics — who say his e-mail offers proof of collusion between scientists to distort evidence to support their assertion that human activity is influencing climate change.

I think he's guilty of making a horrible decision that night - which inadvertently changed his life forever. I'm professional bar hopper and connoisseur of exotic pussy. But I know better then to take women like that to my home. Usually, women who get all-out wasted are problems from the get go (Learned that lesson in High School). That's why I usually back off when they get to that annoying point of drunkeness and look for something else less intoxicating.






I'm so tired of this asshole and his low-life friends flagging posts, slandering the victim, witnesses, attorneys, and law enforcement. Mr. Driscoll's numerous blogs and press releases were all obviously created by himself and friends for the sole purpose of tainting the jury.

If Kevin Driscoll was such an outstanding guy, then why was he trolling bars for drunk women? And, if he new that the victim was heavily intoxicated and slightly incoherent at times that evening. Then why didn't he call her a cab or find a different room to sleep in?

• My best guess is he's out trolling bars for the same reason she was. Why should a drunk call another drunk a cab? Did she call him a cab? From what I understand, and I don't spend much time on this, it was HIS bed. She took her underwear off and crawled in. Makes me say, hummmmmmmmm?

Either way, enjoy your freedom while you can Kevin. Because, the D.A. will re-file this case in January and will most certainly get a conviction the second time around.

• I don't know any of these people so I don't flag any of it From the little I've picked up it sounds like she wanted to get hooked up and did and then yelled rape. When he is acquitted I hope he sues her. If you remove your underwear and crawl in bed with someone I'd say you consented, rough sex or not. Getting roughed up doesn't mean you didn't consent to sex. You may not have anticipated rough sex but you consented to sex.

I would agree 100%. I think BOTH sides need to tone it down. There really hasn't been much said about the victim as a person in the last few days (aside from things she has said in court) but there has been an awful lot of personal attacks against Kevin. The trial is over, we all have to wait and see what will happen next. These kind of cases are hard because the charges and accusations are so serious... it's certainly a he said she said situation, and it's a contraversial topic.

To the supporters of Kevin, a good point was made, so please try to be mindful of the things you say. I know none of us want to hurt Kevin so let's make sure that our emotions don't get in the way of seeing the big picture.
To the supporters of the victim and prosecution, I would ask that you give the same respect you are asking for in return. I can't speak for anyone else, but I will ease up if you do.

All this anger on both sides is proving my point that the case has gotten personal and emotions have taken over. That is not fair to either side. None of us were there that night. We all "KNOW" what we believe... A man's life is at stake, and it's turning into a 3 ring circus.

Boy did you hit the nail on the head. The new county judge who happens to sell real estate along with his family profits big from his job. He has subdivided his stuff, let Breese go through as he did without following the rules everyone else has to. McCabe is the biggest sneak of them all, I would love to find a way to add up all of the money he has make off of Prineville in the last decade or so with decisions he was involved in. I have to laugh every time his wife intrduces herself as his wife, like it is some badge of honor,wrong lady, you are just married to a sneaky, adulterer.

It goes on here in Crook County too. Officials who's first thought is "what's in it for me" rather then what's good for Crook County and those who already live here. Their behavior deserves scrutiny at all times. Look at those who profit by the decisions of the County and City and follow the trail of money and favors.

It was the first time he had fallen below majority support in those two polls. He had been polling in the low 50s for months after taking office in January with an approval rating just under 70 percent.

Gallup said Obama's drop in its daily tracking poll likely resulted from the contentious debate over healthcare as well as the poor state of the U.S. economy, with millions of Americans out of work.

"Americans are also concerned about the Obama administration's reliance on government spending to solve the nation's problems and the growing federal budget deficit," Gallup said in an analysis of its poll, which surveyed 1,533 people from Tuesday to Thursday. The margin of error was 4 points.

Democrat Obama became the fourth-fastest U.S. president since World War Two to drop below majority support in the Gallup poll, following Republican Gerald Ford, Democrat Bill Clinton and Republican Ronald Reagan.

Peter Brown, assistant director of the Quinnipiac University Polling Institute, said that although Obama's job approval was below 50 percent for the first time nationally, it was not statistically different from his 50 percent approval rating in October.

"Nevertheless, in politics symbols matter and this is not a good symbol for the White House," said Brown. "Moreover, the percentage who approve of the way he is handling the economy has dropped from a split 47-46 percent approval in October to 52-43 percent disapproval today."

Giving Bend a Bad Name (Karmaville)

This story in the local news media lists Kevin Palotay as a "building materials supplier" indicted in the case. Isn't he the manager or owner of Building Solutions here in Bend over on Boyd Acres? Doesn't sound like a good "solution" to me!

Great car, low miles for it's age, could be painted and reupholstered and re wired and basically repaired and you'd have a great classic car. I had a innocent co-worker that was successfully defended in Crook County; but it cost him $24,000 for one trial. Luckily the DA stopped pursuing after they lost but he still had to deal with CSD. They (the prosecutors or police) threatened his wife that she would lose her kids if she didn't help them; the cops lied on the stand about their interview of him. One of the DA's witnesses would not even show up at court. The police trumped up extra charges, so the news reported there was child porn on his computer. They had to give his computer back to him because there was nothing bad on it. A few of us did speak up at work and they didn't fire him.

I would hate to see Kevins bill if he has to go thru another trial. The prosecutors have more funds than defendants. Maybe that is why they worked to get him fired, so he would not have an income to use to defend himself.

I worked with a guy that worked for the Deschutes court system many years ago and he is adamantly against any court proceedings, he had nothing good to say about Deschutes County prosecution. He will not even serve on a jury because of the contempt he has from back then.

Obviously you were in court, I was too... I took notes... did you? I would just like to clarify the SANE nurse's testimony...
That is NOT what she said. She was refering to the bruises, and said they COULD be consistant with an attack... but her own boyfriend stated that it was not uncommon for Melissa to get the same type of bruises from work. Melissa herself said she bruises easily... An expert testified that the bruises were at least 24hrs old when they were photographed... and the prosecutions own witness knew nothing more about bruise analysis than what she read in some articles (Remember when Jody asked her for the lifecycle of a bruise and she said she'd never read that?) ... then she even read aloud in all of her 4 studies... there was never yellowing before 18 hours, 24hrs and up from there... There were no other injuries on Melissa that would be consistant with a "rape-like" attack.
To clarify another thing. The 2 "Abuse Preventions" aren't related to the statment made by the reporter/ex prosecutor about the women who said they were treated the same way. It was a private hearing...where Jody tried to bring in women from his past to suggest he has a history of this. The judge ruled the sex was 1.) Consensual between them and not the rape that Jody was trying to say and 2.) Not relevant to the case. That is why this never came up in court. If it was relevant, you would have heard about Melissa's DUI and how she wasn't even allowed to be drinking or in a bar the night she met Kevin, or her felony Forgery charges. Because that would establish she was a liar with a drinking problem... The article in the Bend Bulletin was supposed to be non biased... clearly it wasn't. The facts were mangled to lead you to believe Kevin has a history of this type of treatment of women, when he does not. One of these is also from an ex 10 years ago, and was later dropped as they got back together.The other thing you haven't heard about that is one of those girls stated that the report the police took wasn't accurate... they twisted her words. Instead of the DA taking that into consideration, she tried to get it in anyway. It didn't work.
You also said "Maybe a girl consents to sex, but does that mean she consents to being roughed up against her will?" I would say that if the sex was consensual, then none of it is against her will... I'm sure you remember when Jody was talking about "If the sex was soo great..." Does this mean to you that bad sex = rape? If so, I hope that the police will come rushing to my door, as I have a list. I remember her saying that because it struck me... she chose to say if the sex was soo great... not if the sex was consensual.
I will be the first to say that Kevin is not an angel. I agree it looks bad he has even 1 restraining order against him. I would say the same about Melissa. However, I can say with 100% certainty, from the bottom of my heart and the depths of my soul, the did not commit this crime against Melissa. It is unfortunate that this is happening. I don't think Melissa ever thought this would go to court when she filed her report. I think she thought he would take a plea or it would just go away. Somewhere along the way I think the DA got personal with this and now they will both have to go through it again. Anyway you'd like to spin it, the verdict was a HUNG JURY, meaning that the state did not meet their burden of proof. The jury was to use the facts presented to them in court to reach their verdict, not outside sources or emotion.

Okay, maybe I'm overreacting, so I really need your SERIOUS opinion on this folks: How would you feel if you shopped at a consignment/used type store, bought something for $120 and came home, took it out of the bag and saw a new price tag on it of $78????

First off, for those who will tell me, yes, I do ALREADY feel like a moron for not inspecting the tag..............but otherwise, do you think this is fair? Is anything game just because you have a store??? I was told, basically, tough shit, I get stuff you can't find in Bend and sell it, so if you don't like my price, I'll take it back...........markup from $78 to $120 is pretty stiff if you want to stay in business in a small town like this, I think.

The information that was presented in the Bend Bulletin today isn't accurate. The reporter twisted facts and information. She took information from a private hearing between the Judge, Defense and prosecution, where the judge ruled the information was more than irrelevant, it was inacurate. I think it's obvious where the reporter got this information as I doubt it was the Judge or Defense Attorney... It's funny how the DA's office is complaining that information about Melissa that was unable to be presented in court was leaked on the web, and then in the same breath turned around and did it themselves. We live in a small community and as an unfortunate result, the local media is in the pocket of the Police and DA's office. How many times have you heard any of them report about abuse of power, stacked charges etc. etc. etc. and while it may not happen every day, it does happen. The fact still remains... the DA did not prove her case beyond a shaddow of a doubt... if she had, there would have been a guilty verdict... This being the case, KEVIN DRISCOLL IS INNOCENT.

Think that it's a set up for a discrimination lawsuit? Why? Because it happens everyday that's why. They are teaching their daughter that no matter how she behaves if anyone says anything it's because she is not lily white. In a criminal case, it is 100% up to the prosecution to make their case, and prove beyond reasonable doubt that the defendant commited the crime s/he is being charged with.The defense has no responsiblity to prove their innocense, as they are already innocent until proven guilty. In the case of Kevin Driscoll, the fact that the jury was unable to make a decision and his trial ended with a hung jury, means that the prosecution FAILED to do this. While it would be nice for Kevin to recieve the closure of a NOT GUILTY verdict, the idea that the prosecution would retry the case is ridiculous to me. What a waste of time, energy and tax payer money. Jody Vaughn FAILED to prove her case to atleast 10 of the 12 jurors the first time around... KEVIN IS INNOCENT. Who's to say it isn't a hung jury the next time around... and then what?

Thier mind automatically went there because the poster made it very plain that they thought thier daughter was being singled out because of her "color" whatever that means. I was born and raised right here in Oregon and am nothing but Irish, however, in summer you'd swear I had some "color" of some kind. The poster made it very plain with not so well concealed threats that they could sue Rays for the behavior of the manager. Personally I thought it sounded a lot like the people where were just talking about the bullying in the Prineville middle school. The same "tone" if you will... but yeah..I just took it with a grain of salt myself..just like most of the posts that show up here..They start out reasonable and the further into them you get the less sense they make...Me too I'm afraid!

FAA Flight Delays (Bend)

This FAA debacle yesterday had me fuming..... First off, let me clarify something here. Back in the late 80's/early 90's I actually worked as an air traffic controller, until I had a crystal clear moment of mental clarity and got the hell out! It wasn't the additional 1000+ delays across the country that upset me. It's what was said afterwards by some dipstick idiot in Washington DC. He tells the media that the "Air Traffic Control System is in a Shambles" and that it needs to "have a complete overhaul".

ABSOLUTELY CORRECT, I CAN AGREE WITH THAT ONE......But a question?

What in the heck happened to the 10 BILLION Dollars that were invested to "overhaul" the system, some 8 years ago? Even further back? I don't have the cold hard evidence on my desk, but from what I've seen with "Government Contracts" and how they are done, you can bet that most of that money was pissed away into the wind...... We've all seen how some Governement Contractors work. What would take 6 months and come in under budget in the private sector, will take 2 years and 3 times the budget. Perfect example was when the earthquake hit LA a number years ago. People were up in arms about the contractor who re-built the bridges, for he made a bet and had it incorporated into the contract that if he went over budget and past deadline, he would have to pay back to the city/county penalties and interest. BUT if he came in UNDER or at the quoted budget and was to finish up early, he would receive a bonus. Here was a "Community Minded" guy who wanted to restore the transportation infastructure as quickly as possible, benifitting his fellow man. The Bridges were rebuilt in spin-your-head-drop-your-jaw record time and he earned a 6 million dollar BONUS that he distributed amoung ALL of his employees for a "Job well done".

WOW. Someone who believes in the work hard/get rewarded concept! Or, to sum it all up into a word...... "Incentive".

"Incentive" THAT is what get's America motivated to WORK, EARN and have PRIDE in themselves their community and country.

INSTEAD, we have a current administration that want's to strip every man, woman and child of any INCENTIVE. Why would anyone want to work hard, be sucessful just to have it sucked away and given to someone who has no intention of ever doing anything for themselves? What I see here, is simple "greed". So many people view the Government as a "Cash Cow". Come and get your money! MOOO!!! Geesh...... WARNING: Better look out! That hind tit may look pretty good today, but it may all dry up soon. If you don't let the cow out to pasture and work to take care of it, you will find it DEAD in the lower 40.

Spend, just to spend. A Good example here....A "Study" on the effects of prayer in our Schools, that cost the taxpayers 10 million dollars? Pay me 50 bucks and I'll tell you that it's a good thing and should be continued. I'm sure this statement will most definitely insult some people. Sorry about that? Not in the least. It's in the constitution that I have the freedom of speech. Obviously, tact, kindness and respect are always good things to have, should be used regularly and not be confused with "Political Correctness". But let's fact it...... the "Political Correctness" garbage that we have all been getting hit over the head with for years now, is getting old. People are getting to intimidated to say anything at all. Becoming apathetic. I look at it this way. It's pretty simple folks. If the immigrants who move (legally) here don't like prayer, the atheists don't like prayer, then maybe they should take a real hard look at their options. Maybe it's time to move them back OUT of the USA. After all, we all want quality of life.....wouldn't want someone to be miserable.... After all, In case you haven't noticed.....God and Christianity is what this country was founded on. - Thank You. So get over being "offended" and having a pity party. If I moved to an Indian, Muslim, Communist or whatever Country as an example, I would be expected to learn the language, customs, etc.... In other words, RESPECT that country's belief system. Don't have to agree with it, but RESPECT it. Get my drift?. Again, people in this country either need to stand up for our country's basic founding principles. What is interesting, is that a think tank group at Cornell University did a study during the Reagan years and discovered that if every business, man, woman and child in the USA paid a fair share of a "Flat Tax" of 10%, we would actually have a SURPLUS of money in our budget and have NO NATIONAL DEBT. Imagine that. So if you earn $1.00 or a Bazillion Dollars, the tax rate would be the same, regardless.....10 percent. Nothing more, nothing less.

Instead, it has been calculated, that our children today when born, at the moment of birth, owe approximately $36,000.00 to the national debt and in Two years that figure is expected to reach $50.000.00. Thank you Obama! Need more ink? More paper? Printing all that money takes a lot of ink and paper. Of course China is happy to heavily invest in our country. Might want to contact your local community college to get in the classes on foreign languages and sign up for the course on Chinese. At the rate things are going, China will soon own our country.

People want to "Blame" Bush. To a certain extent....sure, Bush didn't do the economy any favors. We needed to get Bush and his "Good "ol Boy" club out of Washington. However, Obama and his crew coming into Washington today have pretty much shoved the knife the rest of the way in and are twisting it. Hey Mr. President! I'm a small business owner.....business is slow right now for me......can I get MY bailout? Hello?

Had the Government done NOTHING on the bailout, we would have had a huge collapse of the financial and business worlds. But this would have also "Cleaned House" and restored the natural order of things. Sounds harsh and rash, but think about it.... Government bails out wallstreet and the car manufacturers, to "Save Jobs". They still go broke and nothing results. People are still out of work and losing their homes. Main Street USA is dying a very slow and painful death. Meanwhile, Wall Street is getting their huge bonuses. They DESERVE Those bonuses, IF they HONESTLY EARNED THEM without taxpayer dollars.

How many of us either know, or have experienced ourselves, the latest scam from the banking industry? People who have paid their credit card bills on time like clockwork, have good credit and always pay more than the minimum payment are now getting screwed for 30 plus percent interest, due to "Changes"???????? WOW. If you don't believe me, just ask someone. Can't swing a dead cat in this town without hitting someone along side the head that is getting screwed over by the banks. Myself, I had a PERFECT payment history for the last 4 years on credit cards. Then About 5 months ago, I open up my credit card statement and "BANG", my interest rate went from 8 3/4 percent to 31.50 percent! I called them to find out what was going on? They told me that they were under new ownership and that the new company's "Criteria for Credit" was different and that I didn't fit into the "Credit Profile" of the new company! If it wasn't for US, they wouldn't even be in existance. So was the bailout really all that great? Bail them out, so they can stay in business and now they are turning around and SCREWING us back. Had they been left ot sink or swim, it would be a whole different story....... They would be running lean and mean and would be THANKFUL for every consumer they have as a customer. Rather, they stick it to us, to pump up the capital to show profit earnings...... It's eventually going to come back to bite them. More and more people who are on the edge finanacially, are being pushed over now and bankruptcies are exploding in numbers across our country.

We have our mainstream media that is nothing more than puppets on a string that read the news from their teleprompters. Don't believe it? Take a look at the Walter Cronkite Documentary that he produced and then had archived to not be shown until after his death. He spells it out quite frankly. The man was brutally honest and hardly Politically Correct.

So you can view me as a "radical" if you want. You are entirely entitled to your own opinions, just as I am. I am only here to encourage people to take off the rose colored glasses and start looking around with crystal clear 20/20 vision. You do that and you will be amazed at what you find out! If it angers you, that's good! It means you are not dead.

In parting for today, it's reallysimple here. This whole economy/bailout/socialist government control/Political Correctness thing kind of reminds me of a saying that my Grandfather had: "Son, of you don't take care of it today, it's going to be like wiping your ass with a hoop".

On a per-page basis, that is, the AP devoted 52 times as much manpower to the memoir of a former Republican officeholder as to a piece of legislation that will cost trillions of dollars and an untold number of lives. That's what they call accountability journalism.

The police can't do anything because no law has been broken. I agree that the vehicles look like police car pseudo clones but they are in enough of a gray area that nothing can be done. The guy that started Bend Patrol Services I hear is a retired officer from SoCal and researched exactly how close to the line he could get. The security guards that carry guns have to be DPSST certified in order to carry. They can make a citizens arrest (just like anyone) and hold someone until the real Police show up but they had better be right if they go that far. But I guess the bottom line is; who cares. If a look-a-like care is driving around and it works to stop someone from committing a crime because they thinks its the real police- mission accomplished

Unbelieveable! You are a definate example of iminate change, you words are bullshit! As our rights, we are innocent until proven guilty. He started out innocent and remains innocent at this time BECAUSE IT MUST BE PROVEN BEYOND A SHADOW OF DOUBT BY THE ACCUSER SHE WAS IN FACT NOT A WILLING PARTICIPANT and what happened was on purpose against her will at the hands of the accused. The jury should assume the defendant is innocent until the plantiff can prove otherwise, she obviously COULD NOT! Your post below really reflects the tainted part of society. If it goes again your mentallity is EXACTLY why the PUBLIC should go listen for themselves, are you saying the jury select was incompitent? Is it so hard to believe someone JUST MIGHT BE INNOCENT? As far as the "stigma" that's on the plantiff, they are the one that failed to prove their case not the defendant. Who ever made that statement is very nieve, just because someone accuses you of something you think society should label you as such regaurdless of the outcome. Man if that were the case ALL of society would have some sort of "stigma", rediculous.




Hung jury means that neither side has a convincing enough case.

He may be guilty, he may be innocent - but the jury couldn't decide and so we don't know.

Let's look at the two sides and think about which is worse:

1. He is innocent and we spend the money on another trial. We spent money.
2. He is guilty and we don't take it back to trial. We have a rapist on the streets.

2 is worse than 1, therefore it needs to go back to trial.
