Nampa Proposed Ordinance Part Two

Familial status: The state of being in a family or functional family.
Family: Any one of the following:
(1) An individual who is pregnant; or
(2) Two or more individuals related by blood within four degrees of consanguinity, marriage, adoption, or in a foster care relationship.
Functional family: A group of individuals who do not meet the definition of "family," living together as a single housekeeping unit and intending to live together as a single housekeeping unit for the indefinite future. "Functional family" does not include a fraternity, sorority, club, hotel, or other group of persons whose association is temporary or commercial in nature.
Gender identity or expression: A person's gender-related self-perception, appearance, expression or behavior, regardless of that person's sex at birth.
Harass/harassment: Physical conduct or communication directed at another person intentionally for the purpose or effect of creating an intimidating, hostile, or offensive environment with regard to employment, places of public accommodation, public services, or housing.
Housing status: The state of having or not having a fixed residence, including, but not limited to, the state of owning or renting (with or without receiving public housing assistance) a place to live. This includes a person's type of dwelling or shelter, including, but not limited to, single family or multiple family homes, apartments, condominiums, rooming houses, housing cooperatives, hotels, motels, public or subsidized housing units retirement homes, nursing homes, and temporary or long-term shelters.
Irrelevant characteristic/irrelevant characteristics: Any status or condition which is unrelated to a person's ability to:
(1) Safely and competently perform specific duties of a particular job or profession, or qualify for promotion,
(2) Use or benefit from a place of public accommodation,
(3) Use or benefit from public services, or
(4) Acquire, rent, or maintain property.
"Irrelevant characteristics" do not include bona fide occupational qualifications but do include a person's actual or perceived race, religion, ancestry, national origin, color, sex, age, height, weight, student status, marital status, familial status, housing status, veteran status, political affiliation or belief sexual orientation, gender identity or expression, mental or physical limitation, and source of income.
Labor organization: Any union, committee, association, or organized group of employees that exists primarily for the purpose of dealing with employment concerns, grievances, wages, labor disputes, rates of pay, hours of work, or other terms or conditions of employment.
Marital status: The state of being single, married, separated, divorced, in a functional family, or a surviving spouse.
Mental limitation: Actual or perceived disability or handicap, as those terms are defined in the Idaho Persons With Disabilities Civil Rights Act, or limitation regarding mental capabilities unrelated to a person's ability to:
(1) Perform a particular job or profession or qualify for promotion,
(2) Use or benefit from a place of public accommodation,
(3) Use or benefit from public services, or
(4) Acquire, rent, or maintain property.
"Mental limitation" includes, but is not limited to, developmental disabilities, psychological conditions, and the use by any person of adaptive devices, aids, or medication to mitigate such limitations. "Mental limitation" does not include any condition caused by the current use of an illegal or controlled substance or alcohol.
National origin: The country where a person or a person's ancestors were born. Discrimination against a person based on national origin shall include discrimination against nonnaturalized citizens and persons for whom English is a second language.
Perceived: As used in this chapter "perceived" refers to the perception of the respondent and not the perception of the claimant.
Person/persons: One or more individuals, partnerships, associations, or organizations; labor organizations, labor unions, or joint apprenticeship committees; businesses, companies, or corporations; legal representatives, receivers, trusts, or trustees; unincorporated organizations; employers or employment agencies; employees or contractors; realtors, real estate brokers, salespersons, or leasing agents; the City of Nampa, agencies of the city, and any recipient of city funds or any other legal or commercial entity.
Physical limitation: Actual or perceived disability or handicap, as those terms are defined in the Idaho Persons With Disabilities Civil Rights Act, or limitation regarding physical capabilities and human motor performance unrelated to a person's ability to:
(1) Safely and competently perform specific duties of a particular job or profession or qualify for promotion,
(2) Use or benefit from a place of public accommodation,
(3) Use or benefit from public services, or
(4) Acquire, rent, or maintain property.
"Physical limitation" includes, but is not limited to, blindness or partial sightedness, deafness or hearing impairment, muteness, partial or total absence of any body part(s), speech impairment, motor impairment, and the use by any person of adaptive devices or aids to mitigate such limitations.
"Physical limitation" does not include any condition caused by the current use of an illegal or controlled substance, or alcohol.
Place of public accommodation: A place open to the general public that is a facility or business of any educational, governmental, nonprofit, health, day care, entertainment, cultural, recreational, refreshment, transportation, or human services, financial, or other business of any kind, whose goods, services, facilities, activities, privileges, or advantages are extended, offered, sold, rented, leased, or otherwise made available to the public.
Public services: Goods, services, facilities, activities, privileges, or advantages extended, offered, sold, rented, leased, or otherwise made available to the public through a department, agency, board, or commission owned, operated, or managed by or on behalf of the state or a political subdivision of the state or a nonprofit organization, including tax-exempt private agencies, which receive financial support through the solicitation of the general public or through governmental subsidy of any kind.
Real property: Any habitable or potentially habitable land or building, as used in this definition "habitable building" includes, but is not limited to, single and multiple family homes, apartments, condominiums, housing cooperatives, mobile homes or trailers, mobile home or trailer parks, and tenements, including any lease or interest in real property.
Religion: All aspects of religious observance, dress, practice, and belief.
Sexual orientation: Male or female homosexuality, heterosexuality or bisexuality, whether past or present.
Sex: The condition of being male or female. Discrimination based on sex includes sexual harassment, which means unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct or communication of a sexual nature when:
(1) Submission to such conduct or communication is made a term or condition either explicitly or implicitly to obtain employment, public accommodation, or housing; or
(2) Submission to or rejection of such conduct or communication by a person is used as a factor in decisions affecting such person's employment, public accommodation, or housing; or
(3) Such conduct or communication has the purpose or effect of substantially interfering with a person's employment, public accommodation, or housing, or creating an intimidating, hostile, or offensive employment, public accommodation, or housing environment.
Student status: The current state of pursuing a diploma/degree at any educational institution.
Source of income: Any legal source from which a person obtains money.
Veteran status: Having served in any unit of the United States Armed Forces or their reserve components, including the National Guard and the Coast Guard.

297.03. Prohibitions in employment.
(a) Except as otherwise provided, no person shall discriminate against any other person with regard to recruiting, referring, hiring, contracting, compensating, grading, classifying, promoting, demoting, disciplining, terminating or otherwise restricting or conditioning terms and privileges of employment based on:
(1) Irrelevant characteristics; or
(2) The results of physical or mental examinations that are not directly related to the bona fide occupational qualifications for the job sought.
(b) Except as otherwise provided, no person shall discriminate against any other person with regard to offering, selecting, extending, terminating, or otherwise restricting or conditioning terms, privileges, or representation of membership in any labor organization or apprentice program based on irrelevant characteristics.
(c) Except as otherwise provided, no person shall discharge, terminate, expel, or otherwise discriminate against any other person because that person has opposed any discriminatory practice forbidden by this chapter or has filed a complaint, testified, or assisted in any proceeding regarding any discriminatory practice forbidden by this chapter.


297.04. Prohibitions in places of public accommodation.
(a) No person shall discriminate against any other person by withholding, denying, curtailing, or otherwise limiting the full use and enjoyment of places of public accommodations.
(b) No person shall prohibit a breastfeeding mother from or segregate a breastfeeding mother within any place of public accommodation where she and the child would otherwise be authorized to be.

297.05. Prohibitions in provision of public services.
(a) No person shall discriminate against any other person in providing information, offering access, or making referrals regarding public services, or by withholding, denying, curtailing, or otherwise limiting the full use of and benefit from public services.


297.06. Prohibitions in housing.
(a) No person shall discriminate in referring, leasing, selling, renting, showing, advertising, pricing, offering, inspecting, listing, or otherwise making available any real property, including discrimination in providing information and receiving or communicating a bona fide offer on any real property.
(b) No person shall discriminate in (a) the application, conditions, or granting of mortgages or other financing, (b) the offer, conditions, or sale of home-owner or rental insurance, or (c) the contracting of construction, rehabilitation, maintenance, repair, or other improvement of any housing facility.
(c) No person shall refuse to lend money for the purchase or repair of any real property or insure any real property solely because of the location in the city of such real property.
(d) No person shall promote any sale, rental, lease, sublease, exchange, transfer, or assignment of real property by representing that changes are occurring or will occur in an area with respect to any irrelevant characteristics.
(e) No person shall indicate, communicate, or otherwise represent to another person that any real property or interest therein is not available for inspection, sale, rental, or lease knowing in fact it is available, including failing to make a person aware of a real property listing, refusing to permit inspection of real property, and representing that a property has been sold whenin fact it has not.
(f) No person shall offer, solicit, accept, use or retain a listing of real property or an interest therein with the understanding that a person may be discriminated against in a real estate transaction or in the furnishing of facilities or services in connection therewith.


297.07. Other prohibited practices.
(a) No person shall adopt, enforce, or employ any policy or publish, circulate, post, mail, or otherwise broadcast any statement, advertisement, sign, or notice or use a form of application or make a record of inquiry which directly or indirectly discriminates or indicates discrimination in providing employment, public accommodations, public services, or housing.
(b) No person shall discriminate in the publication or distribution of advertising material, information, or solicitation regarding employment, public accommodations, public services, or housing.
(c) No person shall coerce, intimidate, threaten, harass, retaliate against, or interfere with any person:
(1) In the exercise or enjoyment of, or on account of one's having exercised or enjoyed, or on account of one's having aided or encouraged any person in the exercise or enjoyment of, any right protected in this chapter; or
(2) Making a complaint or assisting in an investigation regarding a violation or alleged violation of this chapter.
(d) No person shall require, request, conspire with, assist, or coerce another person to:
(1) Discriminate in any manner prohibited by this chapter; or
(2) Intimidate, threaten, harass, or retaliate against another person for making a complaint or assisting in an investigation regarding an alleged violation of this chapter.
(e) No person shall provide false or misleading information to any authorized person investigating a complaint regarding a violation or alleged violation of this chapter, or sign a complaint for a violation of this chapter based upon false or substantially misleading information.


297.08. Exceptions.
Exceptions to discrimination and harassment under this chapter shall include, but are not limited to:
(a) Employment;
(1) This chapter does not apply to the employment of any person by his/her parent, spouse, or child.
(2) It is permissible to discriminate in hiring and selecting between one person and another based on bona fide occupational qualifications. Upon a claim of discrimination, the Claimant shall have the burden of making a prima facie showing that a qualification or selection is based on an irrelevant characteristic. An employer shall then have the burden of establishing that a qualification or selection criterion is reasonably necessary for the claimant to perform in the normal operation of the business. The Claimant will then have the burden of showing that such qualification or criterion is mere pretext.
(3) It is permissible to give preferential treatment in hiring to veterans and their relatives as required by federal or state law.
(4) It is permissible to engage in a bona fide effort to establish, maintain, or improve employment opportunities for persons protected from discrimination and harassment under this chapter.
(5) It is permissible to consider legal source of income as a bona fide occupational qualification where the employment involves non-compete agreements, trade secrets, or similar legally recognized restraints on employment based on source of income.
(b) Public accommodation and public services;
(1) It is permissible to restrict the use of shower or changing areas in health clubs or recreational facilities on the basis of sex when separate and private shower or changing areas do not exist.
(2) It is permissible to refuse to admit to a place of public accommodation serving alcoholic beverages a person under the legal age for purchasing alcoholic beverages.
(3) It is permissible to refuse to admit persons under 18 years of age to a business providing entertainment or selling literature or merchandise, which the operator of the business deems unsuitable for minors, or which is a "sexually explicit matter" as defined by Idaho Public Acts
(4) It is permissible for an educational institution to limit the use of its facilities to those affiliated with such institution.
(5) It is permissible to provide discounts on products or service to students, minors, and senior citizens.
(6) It is permissible to restrict participation on athletic teams or in athletic events on the basis of age.
(c) Housing;
(1) It is permissible to discriminate in any arrangement for the sharing of a single unit dwelling, the remainder of which is occupied by the owner or a member of his/her immediate family.
(2) It is permissible for the owner of a dwelling devoted entirely to the housing or accommodation of a single sex to restrict occupancy and use on the basis of sex.
(3) This chapter does not require any person ho does not participate in the Federal Section 8 Housing Assistance Program to accept any subsidy, payment assistance, voucher or contribution in connection with such program, or to lease or rent to any tenant or prospective tenant who is relying on such a subsidy as payment for at least part of the rent.

297.09. Other exceptions as required by law.
This chapter shall not be construed to limit rights granted by State or Federal Constitution, law, rule or regulation, including but not limited to, the following:
(a) It is permissible to discriminate in employment, public accommodation, public services, and housing based on a person's age, income level, or mental or physical limitations when such discrimination is required or allowed by Federal, State or local constitution, law, rule or regulation.
(b) It is permissible for a governmental institution to restrict access to any of its facilities or to restrict employment opportunities based on duly adopted institutional policies that conform to Federal, State or local constitution, law, rule or regulation.
(c) This chapter shall not be read to prohibit or interfere with the exercise of a person's first amendment rights.
(d) It is permissible for a religious organization or institution to restrict employment opportunities, housing facilities, or accommodations that are operated as a direct part of religious activities to persons who are members of or who conform to the moral tenets of that religious institution or organization.
(e) It is permissible to limit occupancy in a housing development or to provide public accommodations or employment privileges or assistance to persons of low income, over 55 years of age, or who have a physical or mental limitation.
(f) It is permissible to discriminate based on a person's age when State, Federal, or local law requires it.
(g) It is permissible to refuse to enter into a contract with an unemancipated minor.
(h) Nothing in this chapter shall affect, replace, or diminish the duties, obligations, rights, or remedies as otherwise provided by any union contract, collective bargaining agreement, or Federal, State or local constitution, law, rule or regulation, which shall control over this chapter.
(i) This chapter shall not be read to require an employer, whether public or private, to provide benefits to domestic partners in contravention of the Idaho Constitution.


297.10. Complaints.
(a) Any person claiming to be discriminated against or harassed in violation of this ordinance may file with the Human Relations and Community Services Department (hereafter referred to as "the department") a complaint, in writing, setting forth with reasonable specificity the person or persons alleged to have violated this chapter, the specific nature of the violation and the date(s) of the alleged violation. A person filing a complaint must do so within 180 days of the incident forming the basis of the complaint.
(b) To the extent permitted by law, all written complaints of discrimination in employment, public accommodation, public services, and housing received by the department shall be kept confidential.
(c) The department shall:
(1) Be responsible for receipt, recordation, investigation, mediation, conciliation, recommendation, and/or referral to the Office of the City Attorney;
(2) Ensure there are no undue burdens placed on a Claimant, which might discourage filing of a discrimination complaint;
(3) Commence and complete the complaint investigation, mediation/conciliation, and recommendation process in a timely manner;
(4) Promulgate and publish rules and guidelines for processing, investigating, mediating/conciliating, and recommending resolution of the complaint; and
(5) Refer a complaint it deems valid and sufficiently egregious directly to the City Attorney for review and additional action.


297.11. Investigation and hearing.
(a) During an investigation, the department may request the appearance of witnesses and the production of books, papers, records or other documents that may be relevant to a violation or alleged violation of this chapter.
(b) If the department determines that the complaint and preliminary evidence gathered indicates a prima facie violation of an ordinance in this chapter, the department shall assign a person within the department to conduct a hearing (hereinafter referred to as the "Hearing Officer") within 90 days after completion of its preliminary investigation. The person who is alleged to have committed a violation (the "Respondent") and the claimant shall be sent by regular mail at least 14 days advance, notice of the scheduled date and time of the hearing and a request for each to appear. At the hearing, testimony will be taken. All testimony shall be on the record, under oath and either recorded or transcribed. Both Claimant and Respondent shall be allowed to testify, present evidence, bring witnesses to testify, and to crossexamine all witnesses at the hearing. Technical rules of evidence shall not apply.
(c) A failure of either the Claimant or the Respondent to cooperate with the department may result in an adverse determination for that person at the hearing.


297.12. Findings and recommendations.
The Hearing Officer shall make findings of fact based on the testimony and evidence introduced at the hearing and shall recommend such relief as the Hearing Officer deems appropriate. The Claimant and Respondent shall have the right to appeal the Hearing Officer's findings and recommendations in writing within 30 days to the Director of the department. On appeal, the hearing record and Hearing Officer's findings and recommendations shall be reviewed by the Director of the department, who shall approve, approve with modification, or disapprove of the findings and recommendations. After the Director's review, the department's findings and recommendations shall be served by regular mail on the Claimant and Respondent to the complaint, who shall have 30 days to comply with such findings and recommendations, unless otherwise provided by the department.


297.13. Available recommendations.
Department recommendations may include, but are not limited to one or more of the following:
(a) Ceasing the illegal conduct cited in the complaint and taking steps to alleviate the effect of such illegal conduct;
(b) Providing that the Respondent apologize to the Claimant;
(c) Closing the matter based upon a mediation/ conciliation agreement of the Claimant and Respondent;
(d) Paying actual damages for injury or loss;
(e) Hiring, reinstating, or promoting the Claimant, with or without back pay, or providing such fringe benefits as the Claimant may have been denied;
(f) Selling or leasing of housing or dwelling unit in question to the Claimant;
(g) Admitting the Claimant to a place of public accommodation or extending full and equal use and enjoyment of said place of public accommodation;
(h) Paying some or all of the Claimant's costs, costs incurred at any stage of review;
(i) Posting the explanation of and requirements for compliance with this chapter;
(j) Dismissing the complaint; and
(k) Imposing costs against a Claimant for a frivolously filed claim.

297.14. Civil infraction.
(a) An action for a civil infraction for a violation of this chapter may be initiated by the department on the basis of its investigation of a complaint and issuance of findings and recommendations.
(b) If the department determines that discrimination or harassment took place and the Respondent does not comply with the department's recommendation within the specified time period, the department may refer the matter to the City Attorney, County Prosecutor, the Idaho Department of Civil Rights, the United States Department of Justice, Department of Housing and Urban Development, or other appropriate enforcing agency.
(c) The City Attorney may commence legal action by filing and serving a complaint to obtain injunctive relief or any other remedy in an effort to prevent further discrimination prohibited by this chapter and to remedy the effects of such discrimination.
(d) A violation of a prohibited act in this chapter is designated a municipal civil infraction, is not a crime and shall not be punishable by imprisonment.
(e) Schedule of civil fines. The violation shall be according to the following schedule:
(1) First violation . . . $150.00
(2) Second violation . . . $250.00
(3) Third (or any subsequent) violation . . . $500.00
(f) Continuing violation.
(1) For an offense that is a single and discrete occurrence, a single violation shall accrue (for example, a single act of harassment like a racial epithet). Subsequent single and discrete occurrences shall result in additional violations according to the above schedule (for example, two separate instances of racial epithets would constitute a first and second violation).
(2) For offenses that are continuing in nature, rather than single and discrete, the first violation shall accrue with the first day of the occurrence, and subsequent violations shall accrue for each additional day of that occurrence (for example, an impermissible hiring practice that continues each day on an ongoing basis).
(3) For continuing violations under subsection (f)(2), the day of the first occurrence shall be measured from the day of service of the City Attorney's complaint.


297.15. Private actions.
Any person who is the victim of discrimination in violation of this chapter retains his or her right to pursue any and all other legal action to which the person may be entitled in addition to the remedies available under this chapter. Nothing in this chapter shall be construed to limit rights granted under the laws of the State of Idaho or the United States.

TITLE 12. CIVIL RIGHTS

CHAPTER 295. AFFIRMATIVE ACTION PROGRAM

295.01. Establishment; duties.
(a) There is hereby established an Affirmative Action Program within the City. The Mayor or a designee, hereafter referred to as the Affirmative Action Officer for the City, shall be responsible for administering and implementing the Affirmative Action Plan for the City;
(b) The Affirmative Action Officer shall develop and implement affirmative action programs, including but not limited to:
(1) Reviewing City personnel policies to ensure compliance with the City affirmative action policies. If the Affirmative Action Officer concludes that a hire or promotion is in violation, or may be in violation, of City affirmative action policies, then the Affirmative Action Officer may suspend such personnel transaction for ten days. The Mayor or a designee shall receive all pertinent data regarding such hire or promotion and shall have final authority to determine whether or not such a hire or promotion complies with City affirmative action policies;
(2) Investigating all complaints of discrimination in employment within the City which are referred to the Affirmative Action Officer, if such person is other than the Mayor. The Affirmative Action Officer shall report to the Mayor the results of such investigation;
(3) Developing affirmative action policy recommendations, including an affirmative action plan;
(4) Developing and reviewing procedures for assuring compliance with affirmative action policies and the affirmative action plan; and
(5) Reviewing procedures for recruiting minorities within City employment and forwarding results of such reviews and any recommendations to the Mayor; and
(c) The Mayor shall require that all City departments, board, commissions, agencies, officers and employees shall render to the Affirmative Action Officer whatever reasonable assistance and information is requested by such officer; however, this chapter excludes the City Council and its staff, which is governed by Sections 1-301 and 3-207.3 of the City Charter.

CHAPTER 296. FAIR HOUSING*




296.01. Findings of fact; establishment of rights; authority.
It is hereby found that discrimination in housing adversely affects the continued development, renewal, growth and progress of the City and its inhabitants and that such discrimination is injurious to the public health, safety and general welfare of the City and its inhabitants. The opportunity to purchase, lease, sell, hold, use and transfer real property, or an interest therein, which is utilized for housing accommodation in the City, without discrimination because of religion, race, color, sex, age, marital status, ancestry, national origin, political orientation, handicap, the use of adaptive devices, or an individual's or group's income being derived in whole or in part from alimony, child support or public assistance funds, is a civil right established by this chapter which is enacted pursuant to the police powers granted to the City by State law, by the 1968 Fair Housing Law (Title VIII and IX of the Civil Rights Act of 1968, 42 U.S.C. 3601 et seq., as amended, and 42 U.S.C. 3631, as amended) by the Housing and Community Development Act of 1974, as amended, and by other applicable laws.

296.02. Definitions.
As used in this chapter, unless a different meaning appears clearly from the context:
Discriminate or discrimination includes making a decision, offering to make a decision, refraining from making a decision or treating individuals or groups, or the friends or associates of such individuals or groups, differently, in the sale, exchange, lease, assignment, transfer, sublease, rental, financing or insuring of housing units, real estate or housing accommodations based in whole or in part on race, color, religion, ancestry, sex, age, national origin, political orientation, marital status, handicap, the use of adaptive devices, or the income of an individual or group being derived in whole or in part from alimony, child support or public assistance funds.
Entity includes an association, partnership or corporation and the officers and members thereof.
Financial institution means any entity regularly engaged in the business of lending money or guaranteeing loans on real property or any interest therein.
Housing accommodation includes improved or unimproved real property, or a part thereof, which is used or occupied, or is intended, arranged or designed to be used or occupied, as the home or residence of one or more persons.
Immediate family means a spouse, parent, child or sibling.
Owner includes the lessee, lessor, sublessee, sublessor, assignee, assignor, managing agent or other person having the right of ownership or possession or the right to sell, rent, transfer or lease any housing accommodation or any interest or part thereof.
Real estate broker or salesperson means a person, whether licensed or not, who, for or with the expectation of receiving a consideration, lists, sells, purchases, exchanges, rents or leases real property or an interest therein; negotiates or attempts to negotiate any of such activities; holds himself or herself out as engaging in such activities; negotiates or attempts to negotiate a loan secured or to be secured by a mortgage or other encumbrance upon real property or an interest therein; or is engaged in the business of listing real property or an interest therein in publications. "Real estate broker" or "salesperson" also means a person employed by or acting on behalf of a real estate broker or salesperson.
Real estate transaction means the sale, exchange, rental, lease, transfer, assignment or sublease of real property or an interest therein concerning housing accommodations.
Real property includes a structure, a building, a mobile home, real estate, land, a mobile home park, a trailer park, a tenement, a leasehold or an interest in a real estate cooperative or condominium.

296.03. Discrimination prohibited.
Subject to Section 296.04, no person engaging in a real estate transaction concerning housing accommodations, and no real estate broker or salesperson, shall, wholly or partly for reasons of religion, race, color, sex, age, marital status, ancestry, national origin, political orientation, handicap, the use of adaptive devices, or the fact that the income of a person, or of a person residing with that person, is derived in whole or in part from alimony, child support or public assistance funds:
(a) Refuse to engage in a real estate transaction with a person;
(b) Refuse to receive from a person or transmit to a person a bona fide offer to engage in a real estate transaction;
(c) Refuse to negotiate for a real estate transaction with a person;
(d) Represent to a person that real property or an interest therein is not available for inspection, sale, rental or lease when in fact it is so available, or knowingly fail to bring a property listing to a person's attention, or refuse to permit a person to inspect real property;
(e) Print, circulate, post, mail or otherwise cause to be published a statement, advertisement, notice or sign, or use a form of application for a real estate transaction, or make a record of inquiry in connection with a prospective real estate transaction, which indicates, directly or indirectly, an intent to make a preference, limitation, specification or discrimination with respect thereto;
(f) Offer, solicit, accept, use or retain a listing of real property or an interest therein with the understanding that a person may be discriminated against in a real estate transaction or in the furnishing of facilities or services in connection therewith;
(g) Discriminate against a person in the terms, conditions or privileges of a real estate transaction or in the furnishing of facilities or services in connection therewith; or
(h) Deny a person access to or membership or participation in multiple listing services, real estate brokers organizations or other real estate services.

296.04. Exemptions; interpretation.
(a) This chapter shall not:
(1) Apply to the rental of a room or rooms to three or fewer persons in a single dwelling or two-family unit, the remainder of which dwelling is occupied by either the owner or a member of his or her immediate family or a lessee of the entire dwelling unit or a member of his or her immediate family;
(2) Subject to paragraph (b)(2) hereof, require an owner to offer property or an interest in property to the public at large before selling or renting it;
(3) Subject to paragraph (b)(2) hereof, prohibit owners from giving preference to prospective tenants or buyers for any reason other than religion, race, color, sex, age, national origin, ancestry, political orientation, marital status, handicap, the use of adaptive devices, or the fact that the income of a person, or of a person residing with that person, is derived in whole or in part from alimony, child support or public assistance funds;
(4) Prohibit a religious organization or institution from restricting any of its facilities of housing or accommodation, which are operated as a direct part of religious activities, to persons of the denomination involved;
(5) Prohibit an educational institution from limiting the use of its facilities to those affiliated with such institution; or
(6) Prohibit the obtaining of information relative to the marital status of an individual when such information is necessary for the preparation of a deed or other instrument of conveyance.
(b) Nothing contained in this chapter shall be:
(1) Interpreted as repealing the existing powers of a Human Relations Board to work, through conciliation and education, to eliminate such discrimination in the sale and rental of real property or on other transactions related to the subject matter of this chapter; or
(2) Construed to prohibit any affirmative action plans and programs instituted by any level of government or a private person or group.
(c) With respect to the age provision only, this chapter shall not apply to the sale, rental or lease of housing accommodations meeting the requirements of Federal, State or local housing programs for senior citizens or otherwise intended, advertised, designed or operated for the purpose of providing housing accommodations to persons 50 years or older.
(d) With respect to the source of income provision only, nothing contained in this chapter shall be construed to preclude the making of a good faith business determination involving a person's ability to meet the financial burden involved in the sale, lease, rental, sublease, assignment or transfer of housing accommodations. A determination by a person to accept or not to accept rental payments in advance and/or arrearages shall not constitute a violation of this chapter.

296.05. Discrimination by financial or insurance institutions.
(a) Subject to Section 296.04, a person to whom application is made for financial assistance or financing in connection with a real estate transaction or in connection with the insurance, construction, rehabilitation, repair, maintenance or improvement of real property, or an interest therein, which is utilized for housing accommodations, or a representative of such person shall not:
(1) Discriminate against the applicant because of religion, race, color, national origin, age, sex, marital status, ancestry, political orientation, handicap, the use of adaptive devices, or the fact that the income of the applicant or a person residing with the applicant is derived in whole or in part from alimony, child support or public assistance funds; or
(2) Use a form of application for insurance or financial assistance or financing, or make or keep a record or inquiry in connection with an application for financial assistance or financing, which indicates, directly or indirectly, a preference, limitation, specification or discrimination based on religion, race, color, national origin, age, sex, marital status, ancestry, political orientation, handicap, use of adaptive devices, or the fact that the income of the applicant or a person residing with the applicant is derived in whole or in part from alimony, child support or public assistance funds.
(b) Paragraph (a)(2) hereof shall not apply to a form of application for financial assistance prescribed for the use of a lender regulated as a mortgagee under the National Housing Act, as amended, being 12 U.S.C. 1701 to 1750(g), as amended, or by a regulatory board or officer acting under the statutory authority of the State or the United States.

296.06. Enforcement.
(a) All complaints of housing discrimination received by City departments shall be forwarded to a Nampa Human Relations and Community Services Department for review and investigation. Complaints shall be in writing or, if oral, shall be reduced to writing and shall contain such information and be in such form as the Department requires. The Department shall:
(1) Receive, investigate, make recommendations, initiate and attempt to conciliate any complaints of housing discrimination because of religion, race, color, sex, age, marital status, ancestry, national origin, political orientation, handicap, the use of adaptive devices, or the fact that the income of a person, or of a person residing with that person, is derived in whole or in part from alimony, child support or public assistance funds;
(2) Ensure that no excessive burdens are placed on complainants which might discourage filing of complaints regarding housing discrimination;
(3) Commence and complete complaint processing in a timely manner; and
(4) Promulgate and publish rules and guidelines for the processing, investigation and resolution of complaints.
(b) No person shall coerce, threaten or retaliate against any individual or organization for making a complaint or assisting in an investigation regarding a violation or alleged violation of this chapter or require, request, conspire with, assist or coerce another person to retaliate against any individual or organization for making a complaint or assisting in any investigation pursuant to this chapter.
(c) No person shall conspire with, assist, coerce or request another person to discriminate in any manner prohibited by this chapter.
(d) No person shall provide false or substantially misleading information to any authorized person investigating a complaint regarding a violation of this chapter, or sign a complaint for a violation of this chapter based upon false or substantially misleading information.

296.07. Representation of a change in composition of an area.
No person shall represent, for the purpose of promoting or inducing a real estate transaction from which such person may benefit financially, that a change has occurred or will or may occur in the composition of a block, neighborhood or area with respect to religion, race, color, national origin, age, sex, marital status, ancestry, political orientation, use of adaptive devices, or source of income when derived in whole or in part from alimony, child support or public assistance funds, or the owners or occupants in the block, neighborhood or area in which the real property is located, or represent that such change will or may result in the lowering of property values, an increase in criminal or antisocial behavior of the area, or a decline in the quality of schools or other public facilities in the block, neighborhood or area in which such real property is located.

296.08. Conflicts.
Nothing contained in this chapter shall be deemed to supersede, compete with or conflict with any law of the State or the United States relating to discrimination because of race, color, religion, national origin, age, sex, marital status, ancestry, political orientation, handicap, the use of adaptive devices, or the fact that income is derived in whole or in part from alimony, child support or public assistance funds.

296.09. Remedies cumulative; cooperation of city with state civil rights commission.
Nothing in this chapter shall be construed to limit the rights of access by an individual to remedies before the State Civil Rights Commission or before any State court on an individual basis, or to prohibit cooperation between the City and the State Civil Rights Commission.


CHAPTER 297. HUMAN RIGHTS*



297.01. Intent.
The City finds that discrimination on the basis of irrelevant characteristics exists and that it adversely affects all citizens and the quality of life and opportunities available to all people.
And is therefore addressed by this Chapter declaring that discrimination or harassment against any person because of irrelevant characteristics, including actual or perceived race, religion, ancestry, national origin, color, sex, age, height, weight, student status, marital status, familial status, veteran status, political affiliation or belief, sexual orientation, gender identity or expression, mental or physical limitation, or source of income is prohibited.


297.02. Definitions.
As used in this Chapter, the following words and phrases have the following meanings:
Age: Chronological age as measured from date of birth.
Ancestry: The nationality, ethnicity, or family lineage from which a person is a descendent.
Bona fide occupational qualifications: Characteristics that are reasonably necessary for the proper performance or evaluation of an occupation or the normal operation of a business.
Contractor: A person who by contract furnishes services, materials or supplies. "Contractor" does not include a person who is merely a creditor or debtor of the City, such as those holding the City's notes or bonds or persons whose notes, bonds or stock are held by the City.
Discriminate/discrimination: To harass or treat differently or the act of harassing or treating differently, a person, or the person's friends, relatives, or associates, based in whole or in part on irrelevant characteristics of that person.
Employee: A person, paid or unpaid, performing work duties for an employer, including an applicant for paid or volunteer employment, or a participant in a training or apprenticeship program.
Employer: Any person with a business located within or doing business within the corporate City limits of Nampa or doing business with the City of Nampa who employs or is seeking to employ five or more employees, including any agent of that person or entity.
Employment: The act of an employee performing work duties for an employer.
Employment agency: Any person, paid or unpaid, who regularly undertakes to procure, refer, recruit, or place an employee with an employer, including any agent of that person.

Assign reporters to interview members of the LGBT Community (Nampa, Boise)

I would like the Idaho Press Tribune, other news editors, and producers, to assign reporters to interview members of the Gay, Lesbian, Bisexual, and Transgender community then write or brodcast a story on what it's like to be in that community, what issues we face in the treasure valley (especially Nampa), and what we face if we run for public office, or try to get promoted in the workplace. The public needs this education in Idaho in order to form a more well rounded opinion. I challenge your newsources to take up this task as we are members of the community just like any other group of people that has been written about. We need this debate in Nampa and all over Idaho, and we needed it to start yesterday.

The Meaning of Fornication

Fornication is a term which typically refers to voluntary, illicit sexual intercourse between persons not married to each other. [1]

The origin of the word derives from Latin. The word fornix means "an archway" or "vault" and it became a common euphemism for a brothel as prostitutes could be solicited in the vaults beneath Rome. More directly, fornication means "done in the archway"; thus it originally referred to prostitution. The first recorded use of the noun in its modern meaning was in 1303 AD, with the verb fornicate first recorded around 250 years later.[2]

The Merriam Webster Dictionary defines Fornication as "consensual sexual intercourse between two persons not married to each other" [3]

Fornication is dealt with differently in various religions, societies and cultures.

Given the true definition of fornication anyone that isn't married and has sex is committing fornication.

Adultery is referred to as extramarital sex, philandery, or infidelity, but does not include fornication. The term "adultery" for many people carries a moral or religious association, while the term "extramarital sex" is morally or judgmentally neutral.

So the only commandment that even comes a little close in the 10 commandments is the one on adultery. I follow the red letters of Jesus and the ten commandments. Those that make up their own definitions are not following what Jesus said and that was" Do unto others as you would have them do unto you and love one another as thyself. If you follow those two commandments you are following all ten, so please don't interpret the bible to discriminate against anyone that's not breaking Jesus' commandments. Man can write anything, but according to the Roman historians including Tiberius, Jesus did exist and New Testament history is true. I will follow Jesus' commandments, thank you!!!

I apologize to LDS Church-Salt Lake OKs gay rights laws with Mormon ba

SALT LAKE CITY — The Mormon church for the first time has announced its support of gay rights legislation, an endorsement that helped gain unanimous approval for Salt Lake city laws banning discrimination against gays in housing and employment.

The Utah-based church's support ahead of Tuesday night's vote came despite its steadfast opposition to gay marriage, reflected in the high-profile role it played last year in California's Proposition 8 ballot measure that barred such unions.

"The church supports these ordinances because they are fair and reasonable and do not do violence to the institution of marriage," Michael Otterson, the director of public affairs for The Church of Jesus Christ of Latter-day Saints said.

Passage made Salt Lake City the first Utah community to prohibit bias based on sexual orientation or gender identity. Under the two new ordinances, it is illegal to fire someone from their job or evict someone from their residence because they are lesbian, bisexual, gay or transgender.

Utah lawmakers tend to quickly fall in line when the influential church makes a rare foray into legislative politics. So Tuesday's action could have broad reaching effects in this highly conservative state where more than 80 percent of lawmakers and the governor are church members.

"What happened here tonight I do believe is a historic event," said Brandie Balken, director of the gay rights advocacy group Equality Utah. "I think it establishes that we can stand together on common ground that we don't have to agree on everything, but there are lot of things that we can work on and be allies."

But the church has pointed out an inherent dispute it has with the gay lifestyle. Mormonism considers traditional marriages central to God's plan. Gays are welcome in church, but must remain celibate to retain church callings and full membership.

It's strong support for Proposition 8 in California last year drew a sharp reaction from gay rights supporters nationwide, with many protesting outside temples that singled out Mormons as the key culprits in restricting the rights of gay couples.

Since then, however, Utah's gay community has sought to engage church leaders in quiet conversations to help foster better understanding, said Valerie Larabee, executive director of the Utah Pride Center.

"I thought this conversation would never come to be while I was here in Salt Lake City," said Larabee, adding that the discussions have "shifted her perspective of what's possible" and could foreshadow a different relationship between the two sides.

But addressing the council on Tuesday, Otterson said the endorsement is not a shift in the church's position on gay rights and stressed it "remains unequivocally committed to defending the bedrock foundation of marriage between a man and a woman."

Church support for the ordinances is due in part to the way the legislation was drafted to protect those rights. Exceptions in the legislation allow churches to maintain, without penalty, religious principles and religion-based codes of conduct or rules.

"In drafting these ordinances, the city has granted common-sense rights that should be available to everyone, while safeguarding the crucial rights of religious organizations," Otterson said Tuesday .

Previous Utah legislation that sought statewide protections for the gay community did not contain those exceptions.

And although this was the church's first public endorsement of specific legislation, it is not the first time the church has voiced support for some gay rights. In August 2008 the church issued a statement saying it supports gay rights related to hospitalization, medical care, employment, housing or probate as long as they "do not infringe on the integrity of the traditional family or the constitutional rights of churches."

Last year, church leaders were silent on a package of gay rights bills known as the Common Ground Initiative, dooming them from the start.

This essay is not meant for those that are liberal or moderate e.g. the minority in Idaho.

Well into the first quarter of the twenty-first century one would think that we humans have made strides pertaining to human rights, equality for all, and love of ones neighbors. Love for ones neighbors is a message spread far and wide, that is until we listen to Idaho talk radio (especially on weekday mornings). Is Idaho talk radio responsible for the right wing tendency that you may find conversing with the populous of Idaho especially Canyon County Residents? Or do we blame it on the LDS presence in the Valley?

I would argue that it's a combination of those that argue ultra conservative views of that same genre as Sean Hannity, mixed with LDS and other religious intolerance that fuels dislike for our President, the LGBT Community, national healthcare, and anyone that's not caucasian in the Boise Metropolitan Area (especially Nampa and Caldwell). I experienced culture shock when I moved to Seattle from Lansing, Michigan in January of 2007, as I (a transgender person) was totally accepted there. In Michigan only a few totally accepted me when I switched from being Charles to being Melissa. Only a few in a city and county controlled by Democrats. I really experienced culture shock when I was forced to transfer to Boise by my employer. Culture shock when I walked for miles along Main Street in Boise and never seen one African American, Asian, or Hispanic person. That culture shock multiplied when I turned on Boise and Nampa AM radio.

Here in Idaho , one must ask why people of many cultures exist in other states, but not in our state. Isn't Idaho very Christian? It's supposed to be. Why I see churches everywhere I look and our hospitals are named after saints. Didn't Jesus say that we must love one another as thyself? What happened here that caused Idahoans to be reclusive with the rest of the world? We can get a quick opinion of Idaho when we try to pass human rights and anti-discrimination laws that cover gay, lesbians, or transgender people or when we try to get civil union laws passed. Every year Idaho Equality (a 501c3 non-profit organization) tries ,with the help of a lone Senator, to get anti-discrimination laws passed and each time the bills associated with this never get out of committee. One of the first stories that I read in my local paper in Nampa was about a hate crime concerning the beating of an African American at a Wal-Mart in that city, Go figure!!! Why? If you live in Idaho ask yourself why or ask Kevin Miller of talk radio why? I'm sure that you or Kevin will come up with an answer. I, Melissa Sue Robinson, will personally fight against those ideals as long as I am a resident of this state and I urge those that agree with me to take up the cause.

Here is my rebuttal to the Idaho Press Tribune blog posted below: I first thought that I wouldn't run as an independent, because I thought you needed thousands of signatures in order to do that, as you did in Michigan where I am originally from.When I found out different from someone, I changed my mind. Second I only received 2.8 percent of the votes, because I was running against a popular mayor, Tom Dale, I was new to Nampa, voter turnout was very low, and I was a trangender candidate. I am a serious candidate, but the IDP Editor doesn't think so. I would make a great State Rep. and could do as well as, or better than anyone that runs against me. A well known newspaper editor came out with an opinion (Boise, Nampa Idaho)

I just announced that I was running for Idaho State Representative in District 12 B e.g. Nampa, Idaho. I am new to the area and was running against a very popular Mayor, Tom Dale, so I only received 2.8 percent of the vote.
A well known newspaper editor came out with an opinion (with my name in it) in the following Sundays paper saying that people that don't get at least 5% of the vote should (by law) never be allowed to run again. She reiterated the fact that I only received 2.8%. GO FIGURE!

Many times the media already has a candidate picked before anyone runs against them.
Do you think Maybe the media wants' to run the government? My take on media pertaining to elections: Many newspaper editors and editorial boards have became self proclaimed political experts. Instead of getting real political experts opinion and endorsing candidates from those opinions, they take it upon themselves to sway public opinion. Instead of taking public opinion polls and adding that to the mix, many times they ignore the public.

Upon hearing of the shootings in Texas the other day I watched the news for three hours. My father sent me an email of President Obamas speech as well.
Firstly, I am not really a fan of the Today's Show, and watching what they had to say made me less likely to ever b one. Already the media is going to turn this horrible shooter into some poor picked on guy, when honestly, he HAD NO RIGHT DOING WHAT HE DID! Rumors of him being picked on for being a Muslim. Well Christians are picked on EVERYDAY. Gays are pickd on EVERYDAY. And how many do see of them shooting up people? Everyone gets picked. Its Life. How old was this man? Was a he a little child to be swayed by his classmates tauntings..the few that did happen to maybe joke a little.
Here are the facts people:
He was Opposed to the war in Iraq and Afghanistan, and was soon to be deployed over there.
Soldiers heard him yelling Allahu Akbar-God is Greatest.
He was not randomly shooting, or even shooting particular people. He was methodically trying to shoot every person in the room!


And as for Obamas speech. For all you who made fun of Bush...I hope you're happy. Bush at least cared. He spoke from the heart, while Obama uhsssss his way through a half-hearted speech, spending the first few minutes thanking people, cracking jokes, and doing shoutouts.


Its ridiculous.

People in Idaho tend to be the type that care about their beliefs and vote accordingly. Pushing your agenda on us only makes us resent you, furthermore saying that WE need to change our thought patterns to be more "mainstream" is unamerican! Idaho Politics

IDAHO CITIZENS: This is 2009 and 2010 is coming upon us fast. The time for Idaho reform is now. We need to be progressive pertaining to better transportation in our capital area by having bus rapid transit lanes from Caldwell to Boise. Any municipality with more than 50,000 residents needs six council persons, Four in council districts ,two at large, and we need all government meeting televised on cable. We need civil unions for LGBT people so that they can have proper legal protection under the law. We need anti -discrimination laws and ordinances statewide modeled after "The Matthew Shepard Act" and Michigan's version of the Elliot- Larsen Act of 1964 that includes LGBT people. We need a new jail in Canyon County and we needed it yesterday. It was only going to cost an average of $30.00 per year for the average property owner and voters turned it. This issue will be on the ballot again and we need it passed in order to get criminals off of our streets. To those of you that voted for me in the Nampa Mayoral Race I want to say thank you. I will be able to use your votes again in 2010 as I am running for State Representative in District 12 B which does include Nampa. Health Care Reform

Every argument I have herd agenst Health care Reform jest shows how fickle peaple can be to change, I have not seen any good resone why the goverment should not run health care, The only resone any one should be agents health care reform is if you want to protect the insurance companys,(how really dosnt care for your well being, they jest want your money becouse they are a business). Any one with half a brain could tell you no system is flawless but some systems are better than others, and all Health care Reform is really doing is moveing the bill from the us to the goverment,how pays it with extra taxes. And if you wander how that would work during a recesson well look a Britan after WW2, Citys where completly destroyed and they made it work. As Americans we have fallen behinde Europe in Our helth care system and our Education system. If we want to stay a strong and competive country we need to catch up.

How long have you lived in the city limits? Since March 2009

What other elected positions have you held or run for? Michigan House of Representatives,Michigan State Senate,Mayor of Lansing, MI. Lansing City Council at Large, Highline School District (Desmoines Washington) and Precinct Delegate Republican Party.

Have you ever filed for bankruptcy? Yes during Michigan's severe economic downturn from 2001-2005 things became very tough, they closed our office at Michigan Bell and I filed to save my home.

Are your local taxes paid up? If not, what do you owe and why haven't they been paid? I don't owe any taxes

What are your greatest accomplishments? I founded and owned a 25 employee construction company in Michigan for ten years, I received my degree from Michigan State University within 3.5 years at age 44 and maintained a high GPA. I also helped out in two Presidential campaigns, one for George H.W. Bush in 1992.

What organizations do you belong to? CWA Local

Are you involved in any community causes or activities? If so, what are they and why are you involved? Yes. I founded an organization called The Idaho Coalition on Good Transportation and Clean Air in Aug. 2009. The purpose of this organization is to build a light rail system in the valley or bus lanes from Caldwell to Boise along I-84. I am involved because of the severe traffic congestion on I-84 and the valley's poor air quality.



Why should you be elected? Because I am a progressive,hard worker that loves people,loves Nampa, and I will work very hard to see that all of Nampa Citizens have a voice in city government. I will help take Nampa from good to great, eliminate as much of the gang and drug problem as humanly possible, and make Nampa even more of a great place to raise your families.

What are the first five things you would do if you are elected? Work to change city government by having six council members e.g. four in districts North, South,East,and West Nampa, and two at large for the whole city. Council and other city meetings and events would be televised both on Cable One and online. I would strive with my utmost energy to bring jobs to Nampa by proper marketing as this city has a lot to sell to potential employers. Idaho and Nampa not only has good hard workers and good weather, but it also has some of the lowest business taxes, and business friendly laws in the nation. As mayor I will sell that fact and close the deal to as many large good paying corporations and businesses that I can. I would fight for either light rail or bus lanes on I-84 and last I would organize "The Nampa Promise" a scholarship different from The Idaho Promise w hich would pay for the first two years of college for any student graduating with a 2.0 GPA from any Nampa High School public or private within the Nampa City Limits. The promise would be funded by donations and grants.

What are the weaknesses of your opponent(s)? Two of my opponents do not have any political experience or experience beyond the restaurant industry. I know how the city works, I know how to hire and maintain good city managers or at least be a major player in the hiring process. I would be able to hit the ground running in the mayor's office. The present mayor, while a good person does not believe in proper representation pertaining to you. He doesn't think that you need to be informed e.g. thinks that the four at large council members are enough and city meetings should not be televised according to an email that he sent me. He doesn't answer citizens emails very often and his government is not very open door like mine would be. He has been in there for eight years and I would be a strong fresh change for Nampa. Having balanced budgets in my construction company (even though Nampa' s budget is much larger) I would be a good leader pertaining to that, because the principle is the same, and I did it successfully for many years.

What is the biggest issue in this race and why? The biggest issue is in bringing jobs to Nampa and Canyon County we have the highest unemployment rate and one of the highest foreclosure rates in all of Idaho.

What is your vision for Nampa 10 years in the future? Ten years from now when Idahoans think of there greatest cities Nampa will stand side by side with Boise. Nampa Citizens would no longer drive to Boise for employment, and Nampa will have it's own Zoo. The drug and gang problem will no longer be a problem as I would do everything within my power to strengthen the Police Dept. and create more programs for our young. We would strengthen values education in our schools.

What actions should be taken to best position Nampa for growth as the economy recovers? We need to revamp our city ordinances pertaining to business and have a task force with top business leaders that will develop a business plan for Nampa job creation.

Please list any conflicts of interests (or potential problems) you face if elected? None

Should the city revisit its policy regarding vicious animals? If so, what changes do you feel are needed? The present policy suits Nampa as it protects our citizens.

Would you support lifting the ban on Sunday liquor by-the-drink sales? Yes because that ban is not business friendly and it would not raise the drunk driving arrests or crime rate if it was lifted.

What place should roundabouts have in local transportation planning? Very Little.

Are there any intersections you feel would be good candidates for roundabouts? None they tried that in Lansing, MI and they hindered instead of helped traffic problems.

\Are roundabouts a viable option for this community? No they are a waste of money.

What is the proper role of the city's urban renewal agency? Its sole purpose is to create revenue for continued growth in Nampa and it should not be eliminated, however the public should have more input on when and where an urban renewal district is created instead of giving every developer that wants a project their way without public approval. Bonds should only be issued with public approval.

Does the make-up of the urban renewal board need to be changed? If so, how? The board should not include the Mayor and it should be more diverse i.e. more of Nampa's business people and other citizens should be on that board.

How would you rate the city's efforts to revitalize the downtown area? In cosmetic revitalization Nampa is doing a good job, but in business revitalization Nampa is doing a poor job. In these tough times we need to give businesses every break that we can afford.

What is your position on plans for a new library and public safety
building? As mayor I would be for these project when the economy improves.

Should the Nampa City Council be expanded to five or six council members instead of just four? You be it should and my answer is noted above. It should be expanded to six e.g. four in districts and two at large.

What steps can or should be taken to make city government more transparent and open to the public? All city meetings should be televised, Nampa Police, Nampa Fire Dept, and Nampa Parks and Recreation should have occasional cable and online TV programs and Nampa officials should be out in the public more often

What should the city's role be in improving the Treasure Valley air shed? Explain your answer. I think that Nampa should take the lead in this vital area by imposing anti pollution laws and mandatory vehicle emission testing at least every two years. I think that we should take this seriously and give all cities that are members of the air shed management program our utmost cooperation and time. The reason for my answer is in the bowl (mountains forming a bowl) that the valley sits in which traps pollution thus causing major health problems.

Is there anything else you'd like to comment on? Citizens I want you to know that my only, and I repeat only agenda is Nampa and its citizens. I am a Christian and would work to help our various religious organizations in any way that I can, however that includes helping all citizens whether they are Christian or not feel at home in Nampa providing that they don't break any of our laws. I would strive to support education in Nampa with all of my energy as a well educated population helps bring employers to our city. Boise's "Bridge to Nowhere" (Boise)

Maryanne Jordan, a candidate for Boise City Council, supports the 65 million dollar "Bridge to Nowhere", the streetcar system that will prove to be a boondogle & a drain on Boise taxpayers.

Salt Lake City has an excellent light rail system (left over from the Olympics) but it requires heavy subsidies from the city to keep it afloat. Boise's "Bridge to Nowhere" will insure more torn up roads & higher taxes for Boise residents. If this is what you want, then vote for Maryanne Jordan.

I want to see a Boise Bus system that runs to 7 p.m. during the week with more buses & more bus routes. I want more bicycle paths and safer paths for bikers. More than anything else, I want a councilman who listens to the voters.

That is why I am voting for Lucas for City Council next Tuesday & I hope you will too.

I reposted this because I find it so pathetic that you are threatened by a bunch of moms doing this. Just because it has Glenns name on it you dismiss it, you are pretty enlightened. Whether or not you believe what glenn says or not doesnt matter, some things are actually positive, but I guess unless your political hero says it is , your threatened. Leave moms alone you pathetic stain.
