I am looking for an apartment in the Tupelo area available the beginning of May. I am looking for a ground floor apartment preferably a one bedroom but will gladly take a studio if it is nice. The key thing I am looking for is a somewhat accessible place since I am confined to a wheelchair. That just mainly means it be one floor with doorways wide enough for a wheelchair. The bathroom is not a problem and doesn’t need to be accessible however I do need a tub in the bathroom.

The following is a compilation of upcoming charges to be brought against association members , residents and others at Heardtown Estates in Tupelo , MS.

The criminal investigating division at the state level in Jackson was consulted on charges that can be brought and what statute / code under state law the criminal acts fall and what punishment levels are appropriate for the charge(s). ( documented)

A meeting was held with the local prosecutor here in Tupelo and his comments also follow. (documented)

A meeting was also held with the (a) Justice Court Judge in Tupelo. (documented)

There are Lee County Sheriff Office Crime Reports taken the date of the event(s) and are on file. Four separate deputies investigated these charges at Heardtown.. Check on all this yourself. (documented)

The statute of limitations on prosecuting the crimes below is 3 years as documented by the appropriate authority(s) in writing. As of this internet draft, that clock has 2 and one half years remaining to file. Charges will be filed on all below; not if , but when is best to bring the formal charges for arrest and prosecution.. The sheriff reports document times and dates. ( documented)

Criminal Act One:



The professional couple is to be charged with MALICIOUS MISCHIEF and DISTURBING THE PEACE under MS. Code 97-17-67

--- If the value of the property destroyed, disfigured or injured is in excess of Five Hundred Dollars ($500.00), it shall be a felony punishable--

-- by a fine not exceeding Ten Thousand Dollars ($10,000.00) or imprisonment in the Penitentiary not exceeding five (5) years, or both. --- This the charge that will be brought . (documented)

The Disturbing The Peace Charge and punishment will also be added as to this couple under ( 97-35-15) as added by comment by the local authority (s).



--- conduct which may lead to a breach of the peace, or by any other act, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the county jail not more than six (6) months, or both.



Criminal Act Two:



Indecent Exposure:

Will be brought and is documented.

Ms. 97-29-31 under MS. code of 1972

is guilty of a misdemeanor and, on conviction, shall be punished by a fine not exceeding Five Hundred Dollars ($500.00) or be imprisoned not exceeding six (6) months, or both.

In addition , a local authority comment was made as to which charge can be made-- or additional charges under ( 97-35-11).



--- is guilty of any indecent exposure of his or her person at such place, shall be punished for a misdemeanor. ( see punishment above)



Criminal Act Number Three:



This falls under the fire / arson laws of MS. and was answered by a local top official at the Tupelo Fire Department. He researched the �' exact ' code and stated this is the one that would apply. The state and local contacts were also presented this information and deferred to local TFD since was a fire / arson issue.

There were 24 documented fires that are in direct conflict with the recorded restrictive covenants of Heardtown Estates which very clearly states NO OPEN BURNING OF ANY KIND for obvious reasons.. Numerous written requests to the FIREBUG, neighbors, all the board officers , developers and neighbors ALL went unanswered when help was asked for. Only one came back in writing and that was the Association President , whose remarks more or less condoned or sanctioned the bonfire burnings. In addition , this individual also in writing , more or less dismissed the other criminal acts above in a written email-- although 4 Lee County deputies stated these were criminal acts that were committed! ( all documented).

The charges will be brought against this couple . Hopefully , they can be expanded to include all that attended those bonfires ; board officers, neighbors and others. The ongoing written correspondence ensured all knew this was in violation and as one fire official stated;---- �" This is negligent , reckless , and wrong. They could kill somebody. Since it is a covenants violation that all know yet totally ignore ; it is possibly illegal as to endangerment and negligence charges , not to mention civil law violations.�" ( Another top officials words at TFD ) (documented). Again , the appropriate code is available along with the punishment under state laws.



In addition to all the above , the Department of Human Services ( child services) is being contacted by another source , besides the the parties drafting this , as to other issue (s) at Heardtown Estates. ( documented)



Additional charges may be added to the above and additional parties named as to charges.



As stated , ALL charges will be brought at the appropriate times within the 3 year statute .
