Staff litigation attorney needed for criminal justice non-profit (Brattleboro, VT)

Title: Human Rights Staff Attorney

The Human Rights Defense Center (HRDC) seeks a Staff Attorney to litigate cutting-edge First Amendment prison and jail censorship cases and public records / FOIA cases, as well as selected catastrophic injury lawsuits in U.S. state and federal courts, and engage in coordinated education and outreach work. Substantive areas of specialization will likely include cases against private prison corporations and government officials for human rights and free speech law violations, and public records requests and lawsuits to bring transparency and accountability to prisons and jails across the U.S.

Originally founded as Prison Legal News, the HRDC is a non-profit organization based in Brattleboro, Vermont which publishes the monthly magazine Prison Legal News, as well as self-help and reference books designed to help prisoners improve themselves. The HRDC also engages in advocacy on behalf of those detained in American prisons and jails. The HRDC’s in-house counsel represents PLN in censorship and public records litigation against state, local, federal and private prisons and jails across the United States. The HRDC also represents individuals in select catastrophic injury cases.

The HRDC’s Staff Attorney will be co-counseling with the top civil rights, personal injury and media law attorneys in the country to bring cutting-edge free speech and public records cases on behalf of PLN against prison and jail officials. Other cases are currently under development. The primary work of HRDC’s Staff Attorney will be litigation, including:

• Conduct legal and factual research on issues of free speech, censorship, public records and catastrophic injury litigation, as it relates to current and future cases or issues pertaining to HRDC’s docket; and

• Other litigation responsibilities, including drafting and filing legal briefs, conducting motion-practice, discovery, presenting oral argument, and coordinating amicus strategies.

• Staff counsel will also handle intake, prepare demand letters and negotiate prelitigation settlements as needed. Staff counsel should be able to take a case from intake to conclusion, including trial practice when necessary, and be able to partner and coordinate with local or cooperating counsel.


Additional responsibilities will include:

• Contribute to the developing, planning and implementation of community outreach and advocacy initiatives and educational materials, including public speaking and writing on subjects related to HRDC’s docket;

• Media work, including doing interviews and reviewing press materials as needed, since all HRDC cases have a media component;

• Assist in developing grant proposals and discussing work with donors (some travel may be required); and

• Supervision of legal workers and legal interns, as well as building relations with outside lawyers and organizations to broaden the human resources available to assist with the HRDC’s docket.


Qualifications:

• Minimum of six years litigation experience, with at least some of that experience in complex litigation. Admitted to practice in at least one state.
• Demonstrated commitment to public interest work in social justice issues. The ideal applicant should have a background in corporate accountability, prisoners’ rights, free speech, government accountability, media law and section 1983 litigation.
• Excellent research and writing skills.
• Detail-oriented.
• Ability to document and bill for hours spent on litigation.
• Demonstrated ability to effectively undertake complex legal work.
• Ability to work independently and to manage a variety of tasks simultaneously.
• Creativity in crafting strategies to advance and promote human rights in HRDC priority areas.
• Proven ability to work as member of a team.
• Experience with advocacy outside of or in conjunction with litigation.
• Willingness and ability to travel.
• Willingness to relocate to the Brattleboro, Vermont area.

Compensation:

Salary is commensurate with experience. Benefits include two weeks vacation, holidays, and 100% organization-paid health benefits including medical, dental and vision insurance.

I have a 6 hour hearing for a “Best Interests of a Minor Child” in front of a tribunal
The determination of a real substantial unanticipated change in circumstances has already been met. As well as the determination of negligence against the custodial parent.

Now all parties will present their evidence and witnesses for a “Best Interests” determination.
I am acting as a pro se litigant, I have a Paralegal Certificate (B.U. 2007) and I am a 1st year JD student (on line).
The 16 year old Boy is the center of this dispute is in a perceivable (documented) life threatening situation; the likely outcome will be a reversal of custody in my (father’s) favor.

The boy has a good and uninterrupted relationship with me (the Father) However the boy’s preference is to stay with the negligent parent, due to obligation, manipulation and the allowance of expansive freedoms by the Mom.

Boy goes to school in the father's community, and lives part time with the father presently.

Recent events triggered this “short notice” hearing.

I have little money to spend (but some) and at this late date I cannot find an experienced DR attorney to take on the case even if I have the ~$20,000.—I have been quoted.

South Royalton Legal aid cannot help due to a conflict.

What I seek:
Someone with trial experience to act in an advisory capacity for some prep and at the hearing ; I do not have any “real world” experience in a trial setting. I am not looking for an attorney to file an appearance.

Director of Regulatory Compliance (Montpelier, Vermont)

The primary focus is handling customer complaints, regulatory inquiries (including customer complaint-related inquiries, sweeps, firm-based, etc.), directing and conducting the testing required by NASD Rule 3012, as well as drafting of the report to senior management at the direction of the Chief Compliance Officer (CCO). Recommends changes to the Firm's Written Supervisory Procedures based on testing results, complaints and regulatory changes. Responsible for conducting internal inquiries of Registered Representative(RR) when presented with possible volatile behavior and drafting disciplinary letters. Manages staff of two compliance associates, who conduct field audits, approve the Company's incentive materials and provide general compliance support to the field.

Key Responsibilities:
• Assist the CCO in conducting audits/tests of the Equity Services, Inc. (ESI) and ESI Financial Advisors (EFA) written supervisory procedures, controls and practices for compliance with regulatory requirements.
• Assists the CCO in obtaining the annual compliance certification from the firm's CEO.
• Responsible to review new rules, regulations and proposals to determine impact to firm and make recommendations to the CCO and Management of appropriate changes to the firm's policies and procedures.
• Responsible to assist in responding to regulatory inquiries.
• Investigate potential violations of regulatory requirements or firm procedures by associated persons and make recommendations regarding appropriate disciplinary action.
• Receive, track and assist in the resolution of complaints against the company or its associated persons.
• Ensures proper internal reporting to Management and appropriate reporting to state insurance departments, FINRA, bond and Errors & Omissions (E&O) carriers and law enforcement authorities.
• Makes required regulatory filings, including Form BD, Form ADV, NASD Contact Questionnaire, NASD Rule 3070 filings, etc.
• Responsible for assisting in developing and implementing policy and procedures covering a variety of compliance issues for ESI.
• Assist in the analysis exception reports for inappropriate activities, such as excessive activity or missed mutual fund breakpoints, inactive investment advisory accounts, accounts inconsistent with account objectives, change in account address/investment objectives; report to Management of finds and assist in resolving noted issues.
• Review of independent Registered Independent Advisor (RIA) activities, including review of ADVs, away transactions, written supervisory procedures, coordination of RR/RIA audits.
• Assist the compliance functions of ESI and other companies of the National Life Group as required, including field audits, compliance notices to the field, training meetings, responding to inquiries from the field, etc.
• Review and approve registration applications of new employees and Registered Representatives as needed.
• Assist in needs analysis, development and monitoring of heightened supervision for field representatives.

Job Requirements:
• 5-10 years of industry experience, specifically securities compliance.
• NASD Series 7 and 24 licenses.
• A bachelor's degree or equivalent in years of experience and knowledge is preferred.
• Must have a proficiency in Microsoft Office Suite and FINRA applications
• Must be able to pass a background check.
